2. Nature of Business (B2B)

Pramukh Enterprises operates exclusively as a Business-to-Business (B2B) trading and export firm. Our products, including permanent magnet gearless machines, elevator door systems, and smart control panels, are intended solely for commercial use by certified independent contractors, developers, and facility managers. We do not engage in direct-to-consumer retail sales.

3. Product Specifications and Compliance

While we ensure that the components we source meet stringent industry standards, including IS-17900 regulations, it is the sole responsibility of the purchasing contractor or developer to ensure that the integration, installation, and maintenance of these components comply with all local, regional, and national building codes and safety regulations.

4. Orders, Logistics, and Mercantile Export

• Domestic Operations: Deliveries within India are subject to stock availability and mechanized dispatch schedules from our warehousing facilities.
• International Export: For consignments exported to the Gulf, Africa, the Indian Subcontinent, or other international territories, the buyer is responsible for all applicable import duties, customs clearance fees, and local taxes unless explicitly stated otherwise in the prevailing Incoterms agreed upon in the purchase contract.
• Risk of Loss: The risk of loss or damage to goods passes to the buyer upon delivery to the carrier or as dictated by the specific Incoterms of the purchase order.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Pramukh Enterprises shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, project delays, or data loss, resulting from the use or inability to use our components, website, or services.

6. Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby we provide you services or products shall be governed by and construed in accordance with the laws of India. Any legal disputes, claims, or proceedings arising out of or related to these terms shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat.
